Recently, the Bombay High Court announced an important decision in the case of a doctor who obtained admission to an MBBS program by using false information. However, acknowledging the unfair means, the court decided not to withdraw the doctor’s qualification, citing a potential loss to the nation due to a shortage of doctors. Investigation into MBBS Admission Under the OBC Category:
The petitioner received admission to Lokmanya Tilak Municipal Medical College and Hospital in 2012–2013 under the OBC category. Initiating an investigation due to concerns about the reliability of the Non-Creamy Layer (NCL) certificate resulted in the cancellation of the petitioner’s admission. The inquiry identified differences in the petitioner’s father’s answers about marital status and income, leading to the dismissal of the NCL certificate.

Court Proceedings:
The petitioner claimed that her father’s misrepresentation was because of a misunderstanding about income exemptions after divorce. However, the court discovered evidence contradicting the father’s statements, suggesting false testimony. As a result, the court considered the NCL certificate application invalid.

Despite these irregularities, the court refused to remove the petitioner’s MBBS certification since she had finished the course under a temporary court order. However, authorities reclassified her admission as an open category, and they ordered her to pay the difference in fees and a penalty.
